DoseVault Terms of Use

These Terms of Use (the "Terms") are a legal agreement between you and Vikram Joshi, the developer and publisher of the DoseVault iOS application (the "App", "we", "us"). By downloading, installing, or using DoseVault you agree to these Terms. If you do not agree, do not use the App.

1. DoseVault is not medical advice

DoseVault is a personal logging and tracking tool. It records information that you choose to enter about your own medications, doses, weight, side effects, and measurements.

• The App does not provide medical advice, diagnosis, or treatment, and does not recommend or calculate doses.
• The App is not a medical device and has not been reviewed, cleared, or approved by the FDA, Health Canada, or any other regulator.
• Nothing in the App creates a doctor-patient relationship. Content in the App is never a substitute for the advice of your physician, pharmacist, or other qualified healthcare provider.
• Never start, stop, or change a medication, a dose, or a schedule based on anything shown in the App. Always follow your prescriber's instructions and the labeling provided with your medication.

2. Not for emergencies

Do not use the App to handle a medical emergency. If you believe you have taken an incorrect dose, are experiencing an adverse reaction, or have any urgent medical concern, contact your local emergency services or poison control center immediately.

3. You are responsible for what you enter

The App displays and computes summaries from the information you enter. You are solely responsible for the accuracy of your entries. Always verify medication names, strengths, amounts, and dates against your prescription and pharmacy labeling before relying on anything the App displays.

4. Reminders are a convenience, not a safety system

Dose reminders and vial alerts are delivered on a best-effort basis through iOS notifications. Notifications can be delayed, silenced, or not delivered at all (for example due to Focus modes, Low Power Mode, notification settings, force-quitting the App, a powered-off device, or operating system behavior outside our control). Do not rely on the App as your only means of remembering time-critical medication such as insulin. Maintain your own independent routine for any medication where a missed or late dose could harm you.

5. Estimates and educational content

• The estimated level curve is an educational illustration computed from published half-life values and your own log using a simplified model. It is not a measurement and does not represent your actual blood concentration.
• Bundled compound information (including half-life defaults) comes from general literature, may be flagged as an estimate, may be inaccurate for your situation, and is user-editable. It is provided for convenience only.
• Vial "use-by" countdowns are computed from dates and values you enter. They are not a determination of drug stability, sterility, potency, or safety. Follow your pharmacy's and manufacturer's beyond-use guidance.

6. Assumption of risk

Managing medication is inherently serious. To the maximum extent permitted by law, you assume all risk arising from your use of, or reliance on, the App, including reliance on reminders, logs, estimates, exports, and reports.

7. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use DoseVault on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the App except as permitted by law.

8. Subscriptions and purchases

DoseVault Pro is offered as an auto-renewing subscription and as a one-time lifetime purchase, processed entirely by Apple. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple Account settings. Refunds are handled by Apple under the App Store terms. Logging, reminders, and data export are free.

9. Your data and backups

Your data is stored on your device and, if enabled, in your personal iCloud. We operate no server and cannot access, restore, or recover your data. You are responsible for maintaining backups (device backups, iCloud sync, or the App's free CSV export). See the Privacy Policy.

10. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT NOTIFICATIONS WILL BE DELIVERED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY OR HEALTH OUTCOME, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING RELIANCE ON ANY LOG, REMINDER, ESTIMATE, ALERT, EXPORT, OR REPORT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US THROUGH THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR FIFTY US DOLLARS (USD $50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms.

13. Apple-specific terms

These Terms are between you and us only, not with Apple Inc. ("Apple"), and Apple is not responsible for the App or its content. The following terms apply because the App is distributed through the App Store:

• Scope of license. The license granted above is limited to use of the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except that the App may be accessed by other accounts via Family Sharing or volume purchasing.
• Maintenance and support. We, not Apple, are solely responsible for maintenance and support of the App. Apple has no obligation to furnish any maintenance or support services.
• Warranty. In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Product claims. We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy, or similar legislation.
• Intellectual property. In the event of any third-party claim that the App infringes intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of the claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Termination

These Terms are effective until terminated. Your rights under these Terms end automatically if you fail to comply with them. On termination, stop using the App and delete it. Sections 1 through 6 and 9 through 15 survive termination.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict of law principles, except where the mandatory consumer protection law of your place of residence applies.

16. Changes

If these Terms change, the new version will be posted at this address with a new effective date. Continued use of the App after a change means you accept the updated Terms.
